FDA Form 3852: monthly tobacco user-fee reporting

FDA funds its tobacco program with user fees assessed on manufacturers and importers, in proportion to each company's share of the market. Form 3852 is the monthly statement that share is computed from. Here is what it asks, what backs each figure, and how to investigate differences between FDA and TTB supporting records.

For U.S. domestic manufacturers and importers subject to tobacco user-fee reporting. FDA requires the prior month's removal and excise-tax information by the 20th of each month; quarterly assessment payments are a separate step. Check the official FDA requirements and current form, including current cigar-specific notices.

What the form asks

Form 3852 (current revision 09/2025) reports, for one calendar month, the quantity of tobacco products removed subject to tax (manufacturers) or entered / released for consumption (importers), and the federal excise tax on them, by product category. FDA uses the tax figures across all filers to allocate the year's user fees. Identity fields carry the company's mailing address (1.A), EIN (2) and a contact (3–5); the responsible officer certifies in 15.A–D.

This is a plain-English explanation, not legal or tax advice. The current form, its instructions and 21 CFR Part 1150 govern; confirm the revision at fda.gov before relying on any row number here.

Columns: A quantity and B tax for manufacturers; C quantity and D tax for importers. A company holding both roles fills both sides from separate records. A category with no activity is reported as an explicit zero — a blank is a gap, not a zero.

The records behind each figure

Manufacturer
TTB 5210.5 (monthly report — the tax-paid removals by class) and TTB 5000.24 (the excise tax return — the tax amounts).
Importer
TTB 5220.6 (monthly importer report) and the CBP 7501 entry summaries (volume in block 31, tax in block 38 — excise tax only, not duties or other fees).

Two things the form itself does not model and you must handle in your records: shortages and adjustments on the manufacturer side, and separating excise tax from the other charges on a CBP entry on the importer side.

The tie-out to TTB

  1. Same month. 3852 for August is built from August's 5210.5 / 5220.6 and August's 5000.24 / 7501s — not from shipments invoiced in August.
  2. Classes roll up correctly. Small + large cigarettes = row 9; small + large cigars = row 10. Get the per-class figures from the TTB report, then add.
  3. Units match. Sticks for cigarettes and cigars, pounds for everything else — exactly as on the TTB report.
  4. Tax equals the return. Column B (or D) per row equals the tax on the return (or the CBP entries) for that class group. A difference is a rate table or cut-off problem.
  5. Every category has a fact. Activity, or an explicit zero. Nothing inferred.
Because the same removals appear on two agencies' forms, the safest process prepares both from one reconciled ledger and only then renders the forms — so a correction lands in both places or neither.

Deadline and certification

Due the 20th of the month following the reporting month (a zero-activity month is still due). Fields 15.A–D are the responsible officer's certification: software can prepare and check the draft, but the officer signs and submits. Keep the draft, the supporting TTB/CBP records and the reconciliation together for the retention period that applies to you.
